By using the martinezconcreteandmasonry.com website or engaging Martinez Concrete & Masonry for masonry services, you agree to these terms and conditions. If you do not agree, please do not use our website or services. These terms may be updated from time to time; the current version will always be posted on this page.
Martinez Concrete & Masonry provides residential and commercial masonry contracting services in Martinez, CA and surrounding communities. Services include, but are not limited to, foundation repair, chimney repair, tuckpointing, brick and stone masonry, retaining walls, driveway pavers, and related work.
We reserve the right to decline any project at our discretion. Acceptance of a project is confirmed only through a signed written contract or work order. Website content describing our services is informational only and does not constitute a binding offer.
Written estimates provided by Martinez Concrete & Masonry are valid for 30 days from the date of issue unless otherwise stated. Estimates are based on the information available at the time of the site visit. If conditions discovered during the work differ materially from those observed at the estimate, we will notify you in writing before proceeding with any additional scope or cost.
Verbal estimates or ballpark figures discussed before an on-site assessment are not binding. All pricing is subject to a formal written estimate following an in-person evaluation of the project.
Scheduling is confirmed upon execution of a signed contract and receipt of any required deposit. Start dates are subject to weather, material availability, and prior project completion. We will communicate any schedule changes to you promptly.
If you need to cancel a scheduled project, please notify us as soon as possible. Cancellations made less than 48 hours before the scheduled start date may result in forfeiture of any deposit paid, at our discretion, to cover mobilization costs already incurred.
We reserve the right to postpone or suspend work due to unsafe conditions, including but not limited to severe weather, site access issues, or unpaid balances on the account.
Payment terms are set out in the written contract for each project. Typical arrangements include a deposit at contract signing and a final balance due upon project completion. Specific milestone payments may be outlined for larger projects.
Payment is due as stated in the contract. Invoices not paid within 30 days of the due date may be subject to a late fee of 1.5% per month on the outstanding balance. We reserve the right to suspend work on any project with an overdue balance.
Accepted payment methods will be specified in your contract. Checks returned for insufficient funds will incur a returned check fee in addition to any applicable bank charges.
Where required by law, Martinez Concrete & Masonry will obtain the necessary building permits on your behalf as part of the project. Permit fees may be included in the project estimate or invoiced separately. You agree to provide reasonable access to your property for any required inspections. Projects requiring permits will not be considered complete until all required inspections have been passed.
Martinez Concrete & Masonry warrants that all work will be performed in a workmanlike manner and in conformance with the applicable contract specifications. The specific warranty period and coverage terms will be stated in your written contract.
Warranty coverage applies to defects in workmanship. It does not cover damage resulting from acts of nature, seismic events, flooding, freeze-thaw cycles, soil movement, normal wear and tear, misuse, or work performed by others after our completion.
To make a warranty claim, contact us in writing at estimates@martinezconcreteandmasonry.com. We will respond within a reasonable time and inspect the reported issue at no charge.
Except as expressly stated in your written contract, Martinez Concrete & Masonry makes no other warranties, express or implied, including any implied warranties of merchantability or fitness for a particular purpose. Content on our website - including descriptions of services, typical timelines, and general cost ranges - is provided for informational purposes only and does not constitute a warranty of any kind.
Results shown in photos or described in testimonials represent specific past projects and are not a guarantee of identical outcomes on your project.
To the fullest extent permitted by law, Martinez Concrete & Masonry will not be liable for any indirect, incidental, consequential, or special damages arising out of or related to our services or your use of our website, even if we have been advised of the possibility of such damages.
Our total liability for any claim arising from a specific project will not exceed the total amount you paid us for that project. This limitation applies regardless of the form of action, whether in contract, tort, or otherwise.
